Terms of service
The following conditions apply: (This is a translation of the Dutch terms and conditions. The Dutch translation applies.)
Subscription
- Customer can use the Work Instruction App free of charge for the first month. After this month, the customer has the option to continue using the service as software as a service (SaaS) through a subscription.
- A monthly subscription is available where payment must be made in advance. Subscription costs can be found in the Work Instruction App.
- If the subscription is not paid (on time), the Supplier has the right to stop the service.
- The prices of the Work Instruction App are indexed annually. We will inform you about this at least 1 month in advance.
- The subscriptions are always tacitly renewed for the agreed period.
- The monthly subscription can be canceled monthly with a minimum notice period of 1 month.
- You can cancel your subscription via the App or by contacting the Supplier.
- By taking out the subscription, the customer gives permission to have the subscription costs automatically debited.
Continuity
- The Supplier does its best to ensure that the Work Instruction App functions correctly. The Supplier cannot guarantee that the app will always be available without interruptions, errors or defects or that it will work and that the information is complete, correct or current.
- The Supplier reserves the right to (temporarily) terminate the app (unannounced), without the Customer being able to derive any rights from it.
- The Customer is responsible for having a good backup procedure in place to ensure that his process can function without the Work Instruction App.
- The Supplier is not responsible for data loss, incorrect data, direct or indirect damage due to the improper functioning of the app or related services. Use of the app is at your own risk.
- Customer indemnifies Supplier against all possible claims from third parties arising from the use of the app. Customer will pay all damages and costs incurred by Supplier as a result of such claims.
Privacy, data storage and processing
- The data entered is processed by the Supplier to ensure the proper functioning and invoicing of the app.
- The data that the Customer enters can be stored and processed on one or more servers of the Supplier.
- Information such as, but not limited to, contact details, personal data, employees, telephone number, e-mail address, location, IP address, cookies, photos, transactions are stored and processed for the proper functioning of the service.
- Customer gives Supplier permission to process the (personal) data.
- The servers that Industrial IT uses are located in Europe. The Supplier will make every effort to take appropriate infrastructural and procedural measures to protect personal data against loss or unlawful processing.
- The customer is and remains the owner of the data. If the Customer no longer wishes to use the service, the Supplier will delete the data 30 days after the end date of the subscription. At the request of the Customer, the Supplier can delete this data before this time. At the request of the Customer, the Supplier provides insight into the stored data and the Customer has the option to rectify it.
- You can of course always report complaints about the processing of your personal data to the autoriteit persoonsgegevens
- We keep your billing information such as contact details and invoices for the legal period of 7 years.
- The data will only be used by Industrial IT to improve and/or further develop the service.
- The Work Instruction App only communicates via HTTPS. The safest protocol on the internet.
- Google Analytics is used for analysis of the Work Instruction App.
Changes
- Supplier has the option to stop its services, change prices, functionality or these conditions without prior notice.
- The Supplier has the right to adjust the app and/or service, change or delete data, or temporarily or completely deny the Customer access to the app without prior notification.
Exact Online API
- The Work Instruction App and associated services use the Exact Online API.
- The use of the Exact Online API is limited to 60 requests in a 60-second time window and the API is limited to 5,000 requests per day per company.
- The Work Instruction App uses multiple calls per transaction to keep the database up-to-date. In case of frequent use of the app, the number of requests can exceed these limitations.
- When the Exact Online API limit is reached, the Work Instruction App will no longer work. Customer is aware of this.
Copyright
- Customer may not make the app and/or related services available to third parties, sell, rent, decompile, reverse engineer and/or modify the app and/or related services without prior written permission from the Supplier.
- Customer is not permitted to circumvent or remove technical restrictions designed to protect the app.
- All intellectual property rights and/or similar rights to the (content) app, including the underlying software, images, video and sound fragments, are solely owned by Industrial IT or its licensors.
Maintenance
- The Supplier does its best to make this service as accessible as possible, but offers no guarantees.
- From time to time, the Supplier may update the servers and/or software, which may lead to temporary unavailability. The Supplier will do its best to ensure that this unavailability lasts as short as possible.
- By performing updates, the service may be temporarily unavailable. Updates will preferably be performed outside office hours from 8 a.m. to 5 p.m. Dutch time.
- The Supplier is not responsible for any damage caused by the non-functioning of the app and/or service.
Other conditions
- When you use the app from the Google Play store, Google's terms and conditions apply.
- By taking advantage of the one-month free trial period, you acknowledge that you have no right to withdraw payment under the statutory remote purchase.
- Dutch law is applicable. Disputes are handled by the court in Zutphen.
- The NLdigitaal (2020) conditions apply in addition to the above conditions. The above conditions are overlying to the NLdigitaal (2020) conditions.
